Lawsuit against Evolve Bank

In the lawsuit, the plaintiffs sued Evolve Bank for negligence and other legal breaches after a cyberattack on June 26. Evolve found that the breach exposed customers’ names, Social Security Numbers, birthdates, account details, and other personal information.

Different Charges against Evolve Bank

The plaintiffs are suing for negligence, breach of implied contract, breach of fiduciary duty, and unjust enrichment. They seek class action certification, damages, fees, costs, a jury trial, and court orders for the bank to improve its cyber and data security.

Why Evolve Bank Failed To Give Timely Notice

Evolve Bank did not give timely and adequate notice to affected customers about the data breach, including details on how and when it happened, and when the information was released on the dark web.

“Defendant waited until June 26, 2024, to provide the barest of notice to the Class, only telling them that the breach occurred, that their information was now made available on the dark web by a ‘known cybercriminal organization,’ and that the information involved the most sensitive of [personally identifiable information],”
