As part of the settlement, Charles McGee, litigant alleges that Advance Auto Parts took on a responsibility to handle private information with care. However, they stored this information on a database that was allegedly configured negligently or recklessly.
McGee’s Class Action Lawsuit Against Advance Auto Parts
McGee argues that the data breach, disclosed recently to the U.S. Securities and Exchange Commission by Advance Auto Parts, happened because private information was stored on an unprotected database without password protection.
McGee also claims that Advance Auto Parts did not give sufficient notice to him and other potential class members that their information had been stolen and posted for sale on the dark web.
The plaintiff is asking for a jury trial and seeks injunctive and declaratory relief. They also request actual, consequential, and nominal damages for themselves and all members of the class.
